These Terms of Service apply to your use of our website www.mulberrysilkbedding.co.nz ("the Website") and any purchases of goods from Logic Brands Ltd ("the Company"). Please read these terms carefully. They are available at any time on our website or upon request in writing prior to purchase.

Use of Our Website and Information Accuracy

The website operated by "the Company" and associated materials provide information about products offered by "the Company." We endeavour to ensure all information is accurate and up-to-date. However, occasional errors or omissions may occur. "The Company" is not liable for any direct or indirect losses or damages arising from decisions based on this information. The consumer is solely responsible for any actions or decisions they make. "The Company" reserves the right to make changes to the Website or sales materials at any time without prior notice.

Contract, Payment, and Delivery

By placing an order, you make an offer to purchase goods. Upon order acceptance (confirmed via email, if provided), a contractual relationship is established between you and "the Company." Payment is taken upon order acceptance, and orders cannot be cancelled once accepted except as permitted by law. Please choose your products carefully; we do not provide refunds for change of mind.

If items ordered are no longer available, we will refund any payment made and notify you of the unavailability. "The Company" reserves the right to refuse or cancel any order for any reason.

Goods sold on instalment plans will be delivered once payments are completed as agreed at the time of sale. Failure to meet installment terms may result in the full debt being transferred to a collection agency and repossession of goods. You will be liable for all costs incurred in debt recovery. In all other cases, goods will be delivered after full payment is received. Title to the goods remains with "the Company" until full payment is made.

Delivery is available to New Zealand addresses, with delivery timing determined by "the Company." Delivery times are estimates only and cannot be guaranteed.

Pricing

All prices listed on www.mulberrysilkbedding.co.nz are in New Zealand dollars and include GST. "The Company" reserves the right to change prices at any time without notice.

Return of Goods

The Consumer Guarantees Act, the Fair Trading Act and The Australian Consumer Law provide the basis for our returns policy unless otherwise stated.  Any return courier or postage charges are at your own expense.  Before any return of goods for any reason, contact must be made with a customer service representative via either phone or email in order to receive instructions for the return of the goods. Refunds

Unless a product is purchased with a money-back guarantee or has a significant fault, refunds are not provided. Where applicable, refunds are limited to the purchase price. Trial period fees, shipping, delivery costs, and insurance are non-refundable. When a money-back guarantee applies, a Return Authorization Number (RAN) must be obtained before returning the product within the specified timeframe. Returned goods must be in original packaging and in saleable condition; otherwise, a restocking fee of up to 20% may apply.

Faulty or Defective Goods

If goods fail within the warranty period, please contact customer service to arrange return instructions. Proof of purchase and return details must accompany any return. If goods are defective, "the Company" will, at its discretion, either repair or replace the item. For defects outside the warranty period, "the Company" is not obligated to repair or replace items unless required by law. Repairs outside the warranty period may be arranged for a fee; please contact customer service for details.

In cases of substantial product failure, you may choose a refund or replacement. Our liability, as allowed by law, will be limited to one of the following, at our discretion:

  1. Replacement of the goods or supply of equivalent goods
  2. Repair of the goods
  3. Payment for the cost of repairs.

Replacement goods will:

  • Be of a similar or equivalent product
  • Depend on stock availability
  • Exclude packaging, instructions, or accessories
  • Carry the remainder of the original warranty period

Limitation of Liability

"The Company" is not liable for any personal injury, property damage, costs, or expenses directly or indirectly incurred from the use of any products sold. Under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and other applicable laws, "the Company" cannot limit its liability in some circumstances. Where exclusions are legally permitted, liability shall only apply to the minimum extent required.
